Beschreibung:
<jats:p>The legislation adopted for urgent action against serious forms of crime (organised, white collar, racial) have so contaminated the Italian penal system, that it has abandoned several constitutional guarantees under the pretext of effectiveness. The unbridled use of the penal sanction in the rule of law, the growing use of imprisonment as sanction, the contempt for all rules of procedure considered as obstacles to repression, the weight of public accusation, have made the penal system regress towards «pre-modern» repressive characteristics.</jats:p>
